Ictext Inc. offers a print conversion service to disability offices to scan and convert books and other printed matter from print to e-text. The e-text book can be delivered by mail on CD or over the internet, whichever is requested. This allows the disabled reader to utilized speech software to read the printed material. Inaccessible printed matter is now readily available to the blind and disabled to read on their computer. Ictext Inc. cuts the binding on any book, text book or magazine in order to scan the material. Ictext Inc. is able to scan textbooks for print disabled students without requesting permission from the publishers because of a combination of Fair Use doctrine and the ADA (Americans with Disabilities Act), which mandates access. Ictext Inc. provides the scanning service at the request of the disability office. The disability office is an "authorized entity."' Authorized entities can create alternate media under the Chaffee Amendment of the Copyright Law. The Chaffee Amendment does have certain restrictions. First, permission is required to scan dramatic works (plays, scripts) that are under copyright. Second, the converted materials must contain a notice restricting further duplication and crediting the original copyright holder. The labeling section in the amendment states the following about the alternate format:
The scanned material provided by ictext, inc. will contain the following notice: "Material in a format for use by print disabled student only. Further reproduction or distribution of this material is an infringement of copyright law. Copyright 0000, Publisher's Name." The copyright notice will be on the CD label (if a CD is requested) and in a text file itself. The student shall sign and deliver an ADA Agreement memorializing the terms of use.
